"Supreme Court rules for anti-gay church over military funeral protests
By Bill Mears, CNN Supreme Court Producer"

Washington (CNN) -- A Kansas church known for its angry, anti-gay protests at funerals of U.S. troops won an appeal Wednesday at the Supreme Court in a case testing the competing constitutional rights of free speech and privacy.

In an 8-1 ruling, the justices said that members of Westboro Baptist Church had a right to promote what they call a broad-based message on public matters such as wars. The father of a fallen Marine had sued the small church, saying those protests amounted to targeted harassment and an intentional infliction of emotional distress.

"Speech is powerful. It can stir people to action, move them to tears of both joy and sorrow, and -- as it did here -- inflict great pain. On the facts before us, we cannot react to that pain by punishing the speaker," Chief Justice John Roberts wrote for the majority.

At issue was a delicate test between the privacy rights of grieving families and the free speech rights of demonstrators, however disturbing and provocative their message. Several states have attempted to impose specific limits on when and where the church members can protest.
The church, led by pastor Fred Phelps, believes God is punishing the United States for "the sin of homosexuality" through events including soldiers' deaths. Members have traveled the country shouting at grieving families at funerals and displaying such signs as "Thank God for dead soldiers," "God blew up the troops" and "AIDS cures fags."

Westboro members appeared outside the 2006 funeral for Lance Cpl. Matthew Snyder in Westminster, Maryland, outside Baltimore.

Snyder's family sued the church in 2007, alleging invasion of privacy, intentional infliction of emotional distress and civil conspiracy. A jury awarded the family $2.9 million in compensatory damages, plus $8 million in punitive damages, which were later reduced to $5 million.
The church appealed the case in 2008 to a federal appeals court, which reversed the judgments a year later, siding with the church's allegations that its First Amendment rights were violated.
Albert Snyder, Matthew's father, said his son was not gay and the protesters should not have been at the funeral.

"I was just shocked that any individual could do this to another human being," Snyder told CNN. "I mean, it was inhuman."

Church members said their broader message was aimed at the unspecified actions of the military and those who serve in it. They believe U.S. soldiers deserve to die because they fight for a country that tolerates homosexuality.

In his opinion, Roberts noted the Snyder family was not a "captive audience" to the protests conducted several hundred yards away.

"Westboro stayed well away from the memorial service," Roberts wrote. "Snyder could see no more than the tops of the signs when driving to the funeral. And there is no indication that the picketing itself in any way interfered with the funeral itself."

The court therefore concluded Snyder could not collect damages from Westboro.
But the chief justice showed little sympathy for the message Westboro promotes.

"Westboro believes that America is morally flawed; many Americans might feel the same about Westboro. Westboro's funeral picketing is certainly hurtful and its contribution to public discourse may be negligible," he said. However, "As a nation we have chosen a different course -- to protect even hurtful speech on public issues to ensure that we do not stifle public debate."
The ruling was a narrow one, dealing with the specific, unusual facts of this appeal. Such vocal protests at military funerals are almost entirely confined to this one small group. Roberts said on the free speech question, it was enough to rely on "limited principles that sweep no more broadly than the appropriate context of the instant case."

Only Justice Samuel Alito dissented. He said the church's "outrageous conduct caused petitioner great injury, and the court now compounds that injury by depriving petitioner of a judgment that acknowledges the wrong he suffered," he said. "In order to have a society in which public issues can be openly and vigorously debated, it is not necessary to allow the brutalization of innocent victims like petitioner."

The Supreme Court has never addressed the specific issue of laws designed to protect the "sanctity and dignity of memorial and funeral services" as well as the privacy of family and friends of the deceased. But the high court has recognized the state's interest in protecting people from unwanted protests or communications while in their homes.

The justices were being asked to address how far states and private entities such as cemeteries and churches can go to justify picket-free zones and the use of "floating buffers" to silence or restrict the speech or movements of demonstrators exercising their constitutional rights in a funeral setting.

A majority of states across the nation have responded to the protests with varying levels of control over the Westboro church protesters. In Wednesday's case, 48 states and dozens of members of Congress filed amicus briefs in support of the Snyders.

Church members told the court they have a duty to protest and picket at certain events, including funerals, to promote their religious message: "That God's promise of love and heaven for those who obey him in this life is counterbalanced by God's wrath and hell for those who do not obey him."

The congregation is made up mostly of Phelps and his family. The pastor has 13 children and at least 54 grandchildren and seven great-grandchildren.

He described himself as an "old-time" gospel preacher in a CNN interview in 2006, saying, "You can't preach the Bible without preaching the hatred of God."

Church members have participated in several hundred protests across the country.
In 2009, the high court blocked Missouri's effort to enforce a specific law aimed at the Westboro church. Phelps, daughter Shirley Phelps-Roper and other church members had protested near the August 2005 funeral of a soldier in St. Joseph, Missouri.

State lawmakers later passed the Spc. Edward Lee Myers Law, criminalizing picketing "in front of or about" a funeral location or procession."

"Retired Senior Judge Jose D.L. Marquez almost finished reading the Colorado Supreme Court oath to his daughter before his voice cracked and the tears began.

Monica Marquez had a bet going with her father to see who would cry first as he swore her in to become Colorado's newest Supreme Court justice.

"I think your dad lost the bet," said Chief Justice Michael Bender, who welcomed Marquez to the bench during her swearing-in ceremony at the state Capitol on Friday.

The investiture was attended by Marquez's family, friends and colleagues who represented turning points in her life: a childhood in Grand Junction, a foreign-exchange program in Germany, the campuses of Stanford and Yale, a private law firm in Denver to her last stint as a deputy state attorney general.

"There are singular moments remembered vividly and treasured forever, and I look around today and know this is one of those moments," Marquez said after her partner, Sheila Barthel, and her sister, Christine Marquez-Hudson, helped her into a black robe.

"I look forward, with gratitude, to the adventure that awaits," she said.

Marquez, 41, spoke of three judges who shaped the way she wants to lead her life on the bench, including two she clerked for — 10th U.S. Circuit Court Judge David Ebel and U.S. District Court Judge Michael Ponsor of Massachusetts.

The most influential was her father, who in 1988 became the first Latino appointed to the Colorado Court of Appeals, where he served for 20 years before retiring.

She described him as a humble judge who "greeted the night cleaning crew as warmly as his fellow attorneys."

"How many people have the remarkable good fortune to be sworn into the bar and the bench by their father?" she said.

But the younger Marquez broke even more barriers when she was appointed to the bench by Gov. Bill Ritter in September.

"She is the first Latina to serve on the court . . .

and an openly gay public official in a committed relationship," said Colorado's chief deputy attorney general, Cynthia Coffman. "The court not only gains greater diversity but a woman who excels at building bridges."

Coffman described Marquez's ascent to the bench as a "meteoric rise" but said although lawyers who stood close to Marquez "felt the breeze in their hair," they were not jealous of her success because she worked hard for it.

Ritter said he was confident about choosing Marquez for the slot vacated by retired Chief Justice Mary Mullarkey.

He searched for a justice with a "deep and serious intellect" and found she had the qualities of fairness he was looking for.

"We can find people who take the bench at every level carrying the baggage for someone else," the governor said. "In my conversations with Monica, I found she has a deep respect for the rule of law . . . and that the rule of law in this state applies to all."

"Islamic Schools ‘teaching pupils that gays should be executed’

Around 5,000 children at Islamic weekend schools are being taught homophobic and anti-semitic views, it has been claimed.

According to a BBC Panorama investigation to be screened tonight, the Sharia law classes use textbooks which tell children that the penalty for gay sex is execution, that “Zionists” are plotting to take over the world for the Jews and the correct way to cut off the hands and feet of convicted thieves.

One book for six-year-olds asks children what happens to someone who does not believe in Islam. The answer, according to the programme, is “hellfire”.

There are said to be around 40 weekend schools, which are run under the banner of Saudi Students Clubs and Schools in the UK and Ireland. They teach the Saudi national curriculum and, as they are weekend schools, are not inspected by Ofsted.

According to the Daily Mail, one textbook for 15-year-olds identified by the programme says: “For thieves their hands will be cut off for a first offence, and their foot for a subsequent offence.”

Diagrams showing where cuts should be made accompany the text, which says: : “The specified punishment of the thief is cutting off his right hand at the wrist. Then it is cauterised to prevent him from bleeding to death.”

Gay sex is punished by execution, the schools allegedly teach. However, children are told that clerics are said to differ in whether the guilty person should be stoned, thrown off a cliff or burnt.

Other textbooks are said to ask students to list the “reprehensible” qualities of Jews and claim that Jews are transformed into pigs and monkeys.

Michael Gove, the education secretary, told Panorama: “Saudi Arabia is a sovereign country. I have no desire or wish to intervene in the decisions that the Saudi government makes in its own education system. But I’m clear that we cannot have antisemitic material of any kind being used in English schools.”

The Saudi ambassador to the UK said it had nothing to do with the schools and condemned the “dangerously deceptive and misleading” use of historical texts on Jews.

The Saudi embassy told Panorama: “Any tutoring activities that may have taken place among any other group of Muslims in the United Kingdom are absolutely individual to that group and not affiliated to or endorsed by the Royal Embassy of Saudi Arabia.”

Apple has approved an iPhone app which calls on users to sign up to a declaration against LGBT rights and gay marriage.

The app is based on the Manhattan Declaration, a manifesto released in 2009 by Christian and Catholic leaders which rails against the “erosion” of marriage.

Apple has given the app a 4+ rating, meaning that it contains “no objectionable content”.

The app asks users whether they agree with four statements on abortion and same-sex marriage and those who answer that they are pro-choice and pro-gay marriage are told that they are incorrect.

It also has links to read and sign up to the full declaration, which says that gay relationships are “immoral” and that same-sex marriages are equivalent to sanctioning incest.

The declaration says that signatories act out of “love and “concern for the comment good” rather than prejudice.

One US gay rights group is calling for people to sign a petition to ask Apple to remove the app.

Change.org said: “Apple, for their part, has given the app a rating of 4+. What does that means? According to their rating system, it means that the app contains ‘no objectionable material’. Say what?

“Because it sure seems like if you’re going to call same-sex relationships ‘immoral sexual partnerships’, or if you’re going to accuse gay people of ‘eroding marriage’,or if you say that gay people don’t deserve basic civil rights, that should at least fall into the category of ‘objectionable’.”

Apple could not be reached for comment and a return email said the company’s offices were closed for Thanksgiving. "

Judge Joe Rehyansky advocating corrective rape for lesbians.

"An American judge has been accused of advocating corrective rape for lesbians.

Judge Joe Rehyansky, a part-time magistrate and Vietnam veteran, wrote on conservative news site The Daily Caller that lesbians should be allowed to serve in the military because straight male soldiers could “convert” them.

The Daily Caller swiftly removed some of his remarks but not before they werepicked up by other websites.

Mr Rehyansky, of Hamilton County, Tennessee, argued that men were naturally more promiscuous than women and “it fell to men to swing through the trees and scour the caves in search of as many women as possible to subdue and impregnate – a tough job but someone had to do it”.

Then, he claimed that the “promiscuity” of gay men, coupled with HIV, would have “the potential for disastrous health consequences” if gay men were allowed to serve openly in the military.

“Gays spread disease at a rate out of all proportion to their numbers in our population and should be excluded from the military,” he argued.

He continued: “Shouldn’t the overwhelmingly straight warriors who answer their county’s call be spared the indignity of showering with other men who achieve lascivious enjoyment from the sight of those lithe naked bodies, and who may be tempted to seek more than the view?”

Lesbian military personnel, who Mr Rehyansky praised for their “medical and administrative specialties”, should be allowed to serve because they apparently have low sex drives.

His final argument, which has now been removed by The Daily Caller, was as follows: “My solution would get the distaff part of our homosexual population off our collective ‘Broke Back,’ thus giving straight male GIs a fair shot at converting lesbians and bringing them into the mainstream.”

Mr Rehyansky was accused of advocating corrective rape for lesbians by some commentators.

Blogger Amanda Hess sardonically noted: “Once all the lesbians are easily accessible in one place, an army of straight dudes will turn them all straight, presumably through that time-tested tactic of subduing and impregnating women against their will.”

Baptist Church Bans Softball Team Coached by ‘Deviant’ Lesbian

"(ChattahBox)–Southern Baptists in Tennessee don’t take kindly to the prospect of lesbian softball coaches participating in its adult women’s softball league. After a “very athletic” looking coach registered her team with the Bellevue Baptist Church league, she was told by church officials that her team was not welcome to play in the league, because of her “deviant” lifestyle.

The coach, Jana J. Jacobson, registered her team to compete in the church league and attended a pre-season meeting, in which the league rules of “no alcohol, smoking or cursing and no offensive terms on uniforms” were discussed.

Later, church officials requested an additional meeting with Jacobson and added a new rule of “no public displays of affection.” Apparently the Baptist ministers envisioned a frightening scene of lesbian softball players gone wild, French-kissing and swatting each other’s behinds during games.

Attending the meeting were, Scotty Shows, the church’s recreation minister and Andy Beal, the minister for sports outreach.

According to the report by the Commercial Appeal, Beal told Jacobson that the church “had received information about her lifestyle.” Jacobson quickly determined where the conversation was headed:

‘”Jacobson, who says she’s “very athletic in appearance,” didn’t want to lie, so she acknowledged she is gay. “I continued with … ‘This is silly, we’re simply here to play ball.’”

The conversation went downhill from there, as Jacobson was told her “deviant” lifestyle would prevent her team from participating in league play.

“According to Jacobson, Scotty Shows, the church’s recreation minister who also attended the second meeting, told her that because she was gay the team could not play. She was told that the team’s participation would send a message to Bellevue members that the church condoned her lifestyle.”

The Bellevue Baptist Church has refused to comment."

Lesbian parents have very well-adjusted kids, study finds

"Some people might be surprised by the latest research on children of lesbian parents, published in the journal Pediatrics. But perhaps they should give it more thought.

This was the objective of researchers at the University of California and the University of Amsterdam:
To document the psychological adjustment of adolescents who were conceived through donor insemination by lesbian mothers who enrolled before these offspring were born in the largest, longest running, prospective, longitudinal study of same-sex–parented families.

This was the conclusion:
The [National Longitudinal Lesbian Family Study] adolescents are well-adjusted, demonstrating more competencies and fewer behavioral problems than their peers in the normative American population.

Here's a WebMD story with author Nanette Gartrelle explaining the positive results.

"These are not accidental children," she points out. And that's just for starters.

Self-defence class attracts gay and lesbian community

" The city's gay and lesbian community are fighting back in response to hate crime they say is a growing problem in Edmonton.

About 14 students packed a free self-defence class for the GLBTQ (gay, lesbian, bisexual, trans and queer) community at Grant MacEwan University on Sunday.

"We are targets. It really breaks my heart to say that," said Carol McKinlay, self-defence class instructor and lesbian.

In the class, students were taught how to protect themselves from attackers by kicking and punching.

McKinlay said she experiences discrimination because of her sexuality.

"I still can't walk down Jasper Avenue holding my fiancee's hand," she said.

In April, a lesbian was hospitalized after being kicked in the face.

Shannon Barry, 31, said she was walking near 76 Avenue and 96 Street when a group of men yelled homophobic slurs and attacked.

A 14-year-old boy was charged.

"As progressive as we are, (hate) is still out there. It takes me by surprise," said McKinlay.

The class, held on the last day of the annual Pride Festival, was sponsored by Team Edmonton - a not-for-profit society to promote sports and recreation among GLBTQ people.

A second one is being held July 11.

"This is our way of making sure people have access to this knowledge and keep themselves safe," said Keith Andony, vice president of Team Edmonton.

On McKinlay's registration forms for the class - she also teaches kung fu in the west end - there are boxes to check whether the participant is female, male or transgendered.

Andony said it was great to see and added it was the first time he's seen that.

According to Statistics Canada figures released last week, anti-gay hate crimes have more than doubled in the country from 2007 to 2008."

Vt Supreme Court to hear lesbian custody appeal

"The Vermont Supreme Court weighs in later this week in the long running custody dispute between former lesbian partners.

Lawyers for Lisa Miller are challenging a Family Court judge's decision to give custody to her former partner, Janet Jenkins of Fair Haven. The girl and her birth mother have been in hiding since January when a court-ordered custody swap was to take place.

Jenkins' attorney says the two are believed to have moved to El Salvador. The appeal before the state's high court happens Wednesday."

Lesbian reality show premieres Sunday on Showtime

"Hollywood — Set your DVR: on Sunday night at 10pm, Showtime will introduce the world's first lesbian reality show, "The Real L Word."

The show follows six lipstick lesbians around Los Angeles as they go about their lives. They were clearly chosen by the same agents who cast every show, with backgrounds and issues meant to cause drama and trouble.

The cast includes Rose (a Latina real estate advisor), Mikey (a workaholic marketing director), Nikki and Jill (rich and getting married), Whitney (dreadlocked and juggling several girlfriends), and Tracy (who's also Latina and fresh out of the closet).

So far, critics have not been impressed.

"We follow the lesbians through their boring days and nights, guided only by the fact that they are each lesbians, who cannot stop talking about the lesbianness of being lesbian," wrote
Washington Post television critic Hank Stuever.

"'The Real L World'" is no more or less entertaining than any other reality series," wrote Tim Goodman in the San Francisco Chronicle.

"But it's mostly just a reality series. And that means manufactured scenarios, big drama, tears, tattoos, drinking, sex, swearing and lots of arguing and playing to the camera," wrote Goodman. "Straight people have been making fools of themselves on TV like this for ages."

The Washington Post agrees that in a sad way, "The Real L Word" is a step forward for gay rights.

"Lesbians have just as much right to be miserably narcissistic on miserably stupid reality shows," said Stuever. "Equal misery for all!"

The thing is Montana Courts, Law Enforcment and the Judicial Process does not uphold the law or protect the Victims in Montana in ANY way... but instead enables Crimes against Lesbians in Extreme Anti-Discrimination and Deliberate attacks on the life, the livelihood and the quality of life of Montana Lesbians. In fact the Montana Courts at ALL levels and the Montana Law Enforcement actively participates in Crimes and Deliberate Discrimination against Montana Lesbians.

This new Ordinance if it passes .. make sure it does not give you false illusions and make you feel Safe in Missoula Montana as a Montana Lesbian...

As if to suggest that Missoula Montana is a Lesbian Friendly, Gay Friendly sort of Town when in fact it is quite the opposite when it comes down to Real Civil Rights, Human Rights, Hate Crimes Against Lesbians and protecting the Rights of Montana Lesbians in any way really.

It does not Matter what so ever if there is feeble City Laws or Ordinances that ban Discrimination against Montana Lesbians...

The Missoula Police Department, the University of Montana Police, and the University of Montana President and Staff... well they HOP to it... to Aid and Abet in the Blatant Obstruction of Justice and Denial of Due Process to Do whatever other Corrupt Montana Courts tell them to do in the Blatant - Hate Crime Attacks Against Montana Lesbians.

Hate Crimes are Illegal in Montana, Lesbians are a Protected Class? Are They...?? The University of Montana and the Missoula Law Enforcment Task Force DO NOT seem to have to pay any attention to those Montana Laws or the Civil Rights of Montana Lesbians.

The University of Montana actively participates in Defamation, Hate, Attacks on Lesbians in Montana... this is a Fact..

Discrimination in the Missoula Montana Justice System is Blatant, Obvious, Deliberate, and there is No End in Site, Missoula Ordinance of NOT.

There is no Protection for the Rights of Montana Lesbians in the Missoula Law Enforcement at any level. It is not about the Law, but about the pressure from the Corrupt Courts to Keep Victims in their place... the facts of a case DO NOT matter in Missoula Montana, the Law Enforcement in the Missoula Police Department and the U of M Security Department - They answer to a Higher Power, and that is the Obstruction of Justice, Denial of Due Process, Attack on Civil and Human Rights in Other Montana Counties, Courts at all levels.....
